Terms of Service

These Terms of Service ("Terms") govern your access to and use of agilidy.com, the Brad AI revenue diagnostic tool, and any related services (collectively, the "Services") operated by Agilidy LLC ("Agilidy," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

Agilidy provides revenue consulting services and an AI-powered diagnostic tool ("Brad") that generates a personalized revenue strategy report based on your responses. The Services are intended for informational and business-development purposes only and do not constitute legal, financial, or professional advice.

You must be at least 18 years of age and able to form a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that you will use the Services only on behalf of an entity you are authorized to represent.

You agree to:

• Provide accurate, current, and complete information when submitting diagnostic inputs or contact details
• Not misuse the Services, including attempting to disrupt, reverse-engineer, or gain unauthorized access to any part of the platform
• Not submit content that is unlawful, infringing, defamatory, or otherwise harmful
• Be responsible for all activity that occurs under your session or account

The Services, including all content, reports, software, branding, and materials generated by Agilidy, are owned by Agilidy or its licensors and protected by intellectual property laws. Personalized diagnostic reports are provided to you for your internal business use; you may not redistribute, resell, or publicly publish report content without our prior written consent.

Diagnostic reports and insights are generated using artificial intelligence and may contain inaccuracies or generalizations. You acknowledge that AI-generated content is provided "as is" and should be independently evaluated before being relied upon for business decisions. Agilidy is not liable for decisions made solely on the basis of AI-generated output.

The Services do not constitute legal, financial, accounting, or tax advice. You should consult a qualified professional before making decisions based on diagnostic results or any content provided through the Services.

The Services may contain links to third-party websites or integrate with third-party tools (e.g., scheduling, analytics, AI providers). We are not responsible for the practices or content of third parties. Your interactions with third-party services are solely between you and that third party.

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Agilidy and its affiliates, officers, employees, and contractors shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of (or inability to use) the Services. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us for the Services in the twelve months preceding the claim, or one hundred U.S. dollars ($100) if you have not paid us anything.

You agree to indemnify and hold harmless Agilidy and its affiliates from any claims, damages, or expenses arising from your misuse of the Services, your violation of these Terms, or your infringement of any third-party rights.

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, all rights granted to you under these Terms will cease. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.

We may revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Services after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Sarasota County, Florida, for any disputes arising from these Terms.

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
